Terms of Service

Effective Date: April 1, 2026

These Terms of Service ("Terms") govern your use of the expert witness services provided by Shana Wallace, MD ("Provider," "we," "us," or "our") and your use of our website at wallaceneuroexpert.com. By engaging our services or using our website, you agree to be bound by these Terms.

1. Services Provided

Shana Wallace, MD provides pediatric neurology expert witness services, including but not limited to:

• Medical record review and analysis
• Written expert reports and opinions
• Deposition testimony
• Trial testimony
• Case consultation and strategy support

All services are provided in accordance with professional medical and ethical standards.

2. Engagement and Fees

Each engagement is subject to a separate fee agreement that will specify:

• Scope of services to be provided
• Applicable hourly rates or flat fees
• Retainer requirements
• Billing and payment terms
• Estimated timeline

Current standard rates are available upon request and may be updated periodically.

3. Payment Terms

Unless otherwise specified in a separate fee agreement:

• A retainer may be required before work commences
• Invoices are issued monthly for services rendered
• Payment is due within thirty (30) days of invoice date
• Late payments may be subject to interest charges of 1.5% per month
• We reserve the right to suspend services for accounts more than 60 days past due

4. Cancellation of Scheduled Testimony

For scheduled depositions or trial testimony:

• More than 14 days notice: No cancellation fee
• 7-14 days notice: 50% of estimated testimony fee
• Less than 7 days notice: 100% of estimated testimony fee
• Day-of cancellation: Full day rate plus any non-refundable travel expenses

Rescheduling is subject to availability and may incur additional charges for travel rebooking.

5. Confidentiality

We maintain strict confidentiality of all case materials and communications. We will not disclose case information except:

• As authorized by you in writing
• As required in connection with providing testimony
• As required by law or court order

6. Independence and Objectivity

Dr. Wallace provides independent, objective medical opinions based on her professional judgment and the available evidence. We do not guarantee any particular outcome or opinion. Our role is to provide honest, well-reasoned medical analysis regardless of which party has retained our services.

7. Scope Limitations

Our expert opinions are limited to matters within Dr. Wallace's area of expertise in pediatric neurology. We do not provide:

• Legal advice
• Opinions outside our area of medical expertise
• Guarantees regarding case outcomes
• Medical treatment or patient care

8. Document Retention

We retain case files and work product for a period of seven (7) years following the conclusion of an engagement, unless a longer retention period is required by law or requested in writing. After the retention period, materials will be securely destroyed.

9. Intellectual Property

All written reports, analyses, and work product prepared by Dr. Wallace remain our intellectual property until full payment is received. Upon payment, you receive a license to use the work product for the specific legal matter for which it was prepared.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the fees paid for the specific services giving rise to the claim
• We are not liable for indirect, consequential, or punitive damages
• We are not liable for case outcomes or jury verdicts

11. Indemnification

You agree to indemnify and hold harmless Shana Wallace, MD from any claims, damages, or expenses arising from your use of our services, except to the extent caused by our gross negligence or willful misconduct.

12. Dispute Resolution

Any disputes arising from these Terms or our services shall be:

• First addressed through good-faith negotiation
• If unresolved, submitted to mediation in Charleston, South Carolina
• If mediation fails, resolved through binding arbitration under the rules of the American Arbitration Association

These Terms shall be governed by the laws of the State of South Carolina.

13. Website Use

By using our website, you agree to:

• Use the site only for lawful purposes
• Not attempt to gain unauthorized access to any portion of the site
• Not use the site to transmit malicious code or content
• Provide accurate information when submitting forms

14. Attorney Portal Access

Access to the Attorney Case Portal is provided to authorized legal professionals only. You agree to:

• Keep your access credentials confidential
• Not share portal access with unauthorized individuals
• Notify us immediately if you suspect unauthorized access
• Use the portal only for legitimate case-related purposes

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms. Material changes will be communicated to active clients via email.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with any separate fee agreement and our Privacy Policy, constitute the entire agreement between you and Shana Wallace, MD regarding the subject matter herein.
